Terms of Service

These Terms of Service (“Terms”) govern your use of Memory Mapper, operated by Edev Solutions (“we,” “us,” or “our”). Please read them carefully. If you do not agree with them, please do not use the Service. If you have any questions, you can reach us at support@memory-mapper.com.

1. Acceptance of Terms

By accessing or using Memory Mapper (the “Service”), operated by Edev Solutions, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to everyone who uses the Service, including people who create maps (“creators”) and people who open a shared map (“recipients”).

2. Description of Service

Memory Mapper is a web app that lets people create personal, location-based memory gifts. A creator picks a region of the world, drops pins on meaningful places, and attaches text and photos to each pin. They can then export the map, which produces a public, password-protected link they can send to a recipient, who opens it in any browser and explores the memories without needing an account. We may modify, suspend, or discontinue features of the Service from time to time. Where a change materially and adversely affects your use of a map you have already paid for, we will give reasonable notice where practicable, except where an immediate change is needed for legal, security, or technical reasons.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

The Service is offered from Australia and is directed to users located in Australia. It is not directed to, or intended for use by, individuals located in the European Economic Area (EEA), the United Kingdom, or Switzerland, and we do not market or offer the Service to individuals in those regions. By using the Service, you represent that you are not a resident of the EEA, the UK, or Switzerland.

4. Accounts

  • Creators sign in with a Google account; we do not create or store a separate password for you. You are responsible for keeping access to your Google account secure, and for all activity that happens under your Memory Mapper account.
  • You must provide accurate information and keep it up to date.
  • You must notify us promptly at support@memory-mapper.com of any unauthorized use of your account.
  • Recipients do not need an account. Access to a shared map is controlled by the link and the password the creator sets and shares.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Pricing, payment, and refunds

  • Memory Mapper is priced per map, as a one-off purchase— not as a subscription. Every map starts on the Free tier. A creator may upgrade an individual map to Pro or Max from that map’s editor for a single, one-off charge. See our pricing page for current tiers and limits.
  • Prices are shown in Australian dollars (AUD) and are charged once per map. Upgrading a map applies the new tier’s limits immediately and permanently for that map — there is nothing to renew and nothing to cancel.
  • You may hold a limited number of Free maps at one time, as described on our pricing page. Pro and Max maps are each paid for individually.
  • Payments are processed by Stripe. We do not store your full card details; they are handled by Stripe under its own terms and privacy policy.
  • Except as required by law — including the consumer guarantees under the Australian Consumer Law, which cannot be excluded — fees are non-refundable. Any additional refund rights are set out in our Refund Policy.
  • We may change our prices from time to time. Price changes do not affect maps you have already purchased.

6. Your content and data

  • Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
  • You retain ownership of the content you create or upload — including memory titles, text, notes, photos, and pin locations (“Your Content”).
  • You grant us a limited, worldwide, non-exclusive licence to host, store, process, and display Your Content solely to operate and provide the Service. This includes making a map viewable to anyone who has its share link and password, because displaying your map to recipients is the core purpose of the Service.
  • You are responsible for Your Content. You represent that you have the rights to upload it and to share it with your recipients, and that it does not infringe anyone else’s rights or break any law.
  • We implement reasonable technical and organisational measures to protect Your Content, but no system is completely secure. Keep your own copies of photos and text that matter to you.

7. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Upload, store, or share content that is illegal, infringing, defamatory, harassing, hateful, or otherwise objectionable. In particular, uploading child sexual abuse material (CSAM) or any content that sexualises minors is strictly prohibited; we report such material to the relevant authorities and remove the account.
  • Upload content you do not have the right to use, or that infringes any copyright, trademark, privacy, or other right.
  • Attempt to reverse-engineer, decompile, or gain unauthorized access to the Service’s source code or infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service (for example, through malware, denial-of-service attacks, or scraping).
  • Attempt to guess, brute-force, or otherwise circumvent the password protecting a shared map you were not given access to.
  • Resell, sublicense, or provide the Service to third parties without our written consent.

We may remove content or suspend access if we reasonably believe these rules have been broken. In appropriate circumstances, and at our discretion, we will terminate the accounts of users who repeatedly infringe the copyright or other intellectual property rights of others. If you come across content on the Service that breaks these rules, please report it to support@memory-mapper.com.

8. Intellectual property

  • The Service, including its software, design, branding, and trademarks, is owned by Edev Solutions and protected by intellectual property laws.
  • These Terms do not grant you any rights to our trademarks, logos, or branding.
  • Feedback you provide about the Service may be used by us without restriction or compensation.

9. Third-party services

The Service relies on and integrates with third-party providers. Your use of the Service may also be subject to those providers’ terms. We are not responsible for the content, policies, or practices of any third-party service. The providers we rely on include:

  • Googlesign-in
  • Supabasedatabase and photo storage
  • Stripepayments
  • MapTilermap tiles
  • Vercelhosting
  • Sentryerror monitoring
  • Plausibleprivacy-friendly analytics

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or other law that cannot lawfully be excluded.

11. Limitation of liability

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law — including liability under the Australian Consumer Law, and liability for fraud or for death or personal injury caused by our negligence. The limitations below apply only to the extent the law permits.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDEV SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, CONTENT, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE MAP GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING IT.

Where liability cannot be excluded under the Australian Consumer Law, our liability is limited, to the extent permitted, to resupplying the Service or paying the cost of having it resupplied.

12. Indemnification

You agree to indemnify Edev Solutions against third-party claims, and any reasonable legal costs, that arise from Your Content, your breach of these Terms, or your misuse of the Service. This does not apply to the extent the claim results from our own negligence or breach, and it does not require you to cover any liability that cannot be excluded under the Australian Consumer Law.

13. Termination and deletion

  • You may delete your account at any time from your account settings. Deleting your account removes your maps, memories, notes, and photos from our systems.
  • Maps are subject to inactivity deletion: a map with no visits (by you or a recipient) is retained for a period that depends on its tier — 3 months for Free, 1 year for Pro, and 5 years for Max — after which it may be deleted along with its content. Opening or editing a map, or a recipient opening its share link, resets this period.
  • We may suspend or terminate your access if you materially breach these Terms, or where we reasonably need to for legal, security, or fraud-prevention reasons, or because we are discontinuing the Service. We will give reasonable notice where practicable, unless doing so is impractical or would compromise security or another user’s safety. If we terminate a map you have paid for without any fault on your part, you may request a refund of that purchase in line with our Refund Policy.
  • Upon termination, your right to use the Service ceases. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and indemnification — will remain in effect.

14. Governing law and dispute resolution

These Terms are governed by the laws of Western Australia, Australia, without regard to conflict of law principles. You and Edev Solutions submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts able to hear appeals from them.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they were last revised. If we make material changes, we will provide notice by posting the updated Terms and, where appropriate, by an in-app or email notice. Changes apply only from the date they take effect and do not retroactively change the terms of a map you have already purchased. If you do not agree to a change, you may stop using the Service and delete your account; continued use after the change takes effect constitutes acceptance.
